Terms of use

Last updated: 18 October 2026

1. Scope and Apple's licence agreement

These terms govern your use of the Endurian app for Apple Watch and iPhone (“the app”) and the endurian.app website, provided by Pietro Senoner (“we”). The app is distributed through Apple's App Store and the licence to use it is governed by Apple's Licensed Application End User License Agreement (“Apple's EULA”). These terms supplement it and do not replace it: if there is a conflict on the licence, Apple's EULA prevails. Apple is not a party to these terms and is not responsible for the app, its content or its support.

2. The service and your account

Endurian records sports activities on Apple Watch and iPhone, offers offline topo maps and can sync with third-party services. Some features require an account, created with “Sign in with Apple”. You are responsible for keeping access to your Apple ID and your device secure. The processing of personal data is described in the privacy policy.

3. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices that you own or control, under the terms of Apple's EULA. You may not: use the app or our servers unlawfully or in a way that harms others; interfere with their operation or bypass their technical limits; bulk-download or automate downloads of map files beyond normal use of the app; decompile or modify the app, except to the extent that the law mandatorily allows.

4. Not a medical device

Endurian is a sports and leisure app. It is not a medical device, is not intended to diagnose, treat or prevent any disease and does not provide medical advice. Heart rate, calories, training load and other measurements are indicative. Consult a doctor before starting or increasing physical activity, especially if you have health problems.

5. Sport, safety, navigation and map accuracy

Skiing, mountain activities, climbing, off-road running, cycling and water sports carry risks of personal injury. You take part in these activities at your own risk and according to your abilities.

6. Third-party services and trademarks

If you connect a partner service (Strava, TrainingPeaks, Komoot, Dropbox, Trailforks, Xert or others), your use of it remains subject to that service's own terms and privacy notice, which you must comply with. Partners may change or discontinue their interfaces or services, and with them the Endurian features that depend on them.

Strava, TrainingPeaks, Komoot, Dropbox, Trailforks, Xert, Apple, Garmin, fenix and the other names and trademarks mentioned belong to their respective owners. Endurian is an independent project: it is not affiliated with, sponsored or endorsed by any of them and mentions them only to describe compatibility or inspiration.

7. Your data and content

Your data and workouts remain yours. You authorize us to process them as far as necessary to provide the service you request, as described in the privacy policy. You can delete your account at any time in the app.

8. Intellectual property and open data

The app, the website, the Endurian name and mark, the graphics and the texts belong to Pietro Senoner, except for third-party components. Map and elevation data remain subject to their respective licences, listed on the Credits page.

9. Availability and changes to the service

We do our best to keep the service available, but we do not guarantee uninterrupted or error-free operation. We may change, suspend or discontinue features, including for technical or security reasons or because a partner changes its interfaces, and will inform you where reasonably possible.

10. Warranties and limitation of liability

To the extent permitted by law, the app is provided “as is” and we do not warrant the accuracy or completeness of maps, elevations, tracks and measurements. Nothing in these terms excludes or limits liability for wilful misconduct or gross negligence (Art. 1229 of the Italian Civil Code), for death or personal injury caused by our fault, or the mandatory rights that the law grants to consumers (including those under the Italian Consumer Code, Legislative Decree 206/2005, concerning digital content and services). Subject to the above and to the extent permitted by law, we are not liable for indirect or unforeseeable damage, loss of data, or damage arising from malfunctions of third-party services, network unavailability or decisions made while carrying out activities.

11. Suspension and termination

You can stop using Endurian at any time by deleting your account and uninstalling the app. We may suspend or close an account in case of serious breach of these terms or use that harms the service, giving notice where possible.

12. Changes to these terms

We may update these terms, for example for new features or legal requirements. The version in force is the one published on this page, with its update date; for significant changes we will inform you appropriately. If you do not accept them, you may stop using the service.

13. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer residing in another EU country, the mandatory consumer protection provisions of your country of residence remain unaffected. For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction if it is in the European Union; in other cases the Italian courts have jurisdiction according to the rules of law.
